I am leaving UK with an overstayed visa and my passport in Case ownership Unit. What is going to happen?

Your question is not quite clear. Are you saying that you want to leave as you have overstayed but your passport is still with UKBA? In this case just let them know when you are leaving and they will arrange for your passport to be returned to you in person at the airport on the day. They will ensure that you do indeed leave the country.

If you are asking what will happen to you now that you have been caught overstaying, the answer is much the same. You will be given a number of days to leave the country and your passport will be returned to you at your point of departure.

In any event, if your overstay has been for more than 28 days, you will face a ban of between one and 10 years before you will be permitted to return to the UK. If you had left of your own accord and at no cost to the UK taxpayer the ban would be a year.

Since you have already been caught, there has been expense to the taxpayer, so if you leave of your own accord now, the ban will be five years.

If you are forcibly removed or deported the band is 10 years.
